Terms And ConditionsAccuracyJeremy Lockyer will do his best to produce clear, accurate and unambiguous work in accordance with the client's written instructions. However, he accepts no responsibility for the consequences of any errors, omissions or misunderstandings that arise as a result of a lack of clarity in the client's original material. CancellationWhere an agreement or contract does not exist specifying the conditions for terminating a contract or agreement, either party may terminate the agreement by giving one month's written notice. In such an event, the client will be liable to pay Jeremy Lockyer for expenses incurred and any fees due for work done in respect of the agreement up to the date of termination. Jeremy Lockyer reserves the right to cancel an agreement if he finds the contents of a project unacceptable, as specified below. ContentJeremy Lockyer will stop work on a project immediately if it, or any part of it, appears to contain offensive or defamatory material; breach copyright; break English law; or promote practices or ideas that may cause physical or mental harm to those who read the material. CopyrightOn completion of all work and payment of all outstanding fees and charges (including interest, if applicable), Jeremy Lockyer will transfer to the client all copyright of the project that is owned by Jeremy Lockyer, except for any by-lined work where the copyright remains with the individual author. Jeremy Lockyer will not knowingly produce any copy or design that infringes the copyright or intellectual property rights of any third party, but cannot guarantee or be liable for any infringements of copyright that come to light after the copyright transfers to the client. IndemnityWork carried out by Jeremy Lockyer on behalf of the client is done so on the clear understanding that Jeremy Lockyer will accept no responsibility in respect of any litigation arising from the use or abuse of the work done after it has been supplied to the client. PaymentUnless otherwise agreed in writing, all fees, charges and disbursements are payable within 14 days of Jeremy Lockyer presenting his invoice to the client. However, Jeremy Lockyer reserves the right to require half the estimated cost of the work to be paid in advance and the balance payable on completion of the project. Jeremy Lockyer also reserves the right to charge interest on overdue accounts in accordance with the terms set out in the Late Payment of Commercial Debts (Interest) Act 1998 as amended and supplemented by the Late Payment of Commercial Debts Regulations 2002. If necessary, Jeremy Lockyer may refer late payers to a debt collection agency and/or start legal proceedings to recover the debt. PrivacyJeremy Lockyer will only use a client's details for the purposes of his own business. He does not sell mailing lists to third parties. If another person or company is referred to a client it will only be done if that client requests it or gives their permission in advance. QuotationsAll quotations supplied by Jeremy Lockyer are estimates only and are subject to amendment upon sight of the actual documents submitted, or fresh instructions given, by the client. Virus protectionJeremy Lockyer protects his computer system with anti-virus software that is updated automatically. He expects his clients to do the same and reserves the right to refuse to accept any computer file sent to him that is infected by, or attached to, a virus, worm or Trojan. Samples of workJeremy Lockyer may wish to use samples of work done on behalf of clients for advertising purposes. In such cases, he will only do so after he has received the client's written permission to use their material for these purposes. |
